Platform Terms and Conditions
Article 1 (Application)
These Terms of Use (hereinafter referred to as the "Terms") set forth the rights and obligations between P-HAM, Inc. (hereinafter referred to as the "Company") and users (hereinafter referred to as the "User") in connection with the use of the accommodation reservation system provided by the Company (hereinafter referred to as the "Service").
Article 2 (Service Content and Contract)
- The Service provides Users with the ability to make accommodation reservations with accomodation facilities (hereinafter referred to as the "Accomodation Facilities").
- The reservation contract through the Service is concluded directly between the User and the operator of the Accomodation Facilities, and the Company shall not be a party to the reservation contract nor be involved or liable in any manner regarding its performance or resolution of disputes.
- In addition to the displayed accommodation charges, local taxes such as accommodation tax, bathing tax, and other facility-specific additional charges may be incurred.
Article 3 (Payment)
- If the User selects online payment at the time of reservation, payment shall be made via credit card through the payment service provider designated by the Company, and only credit cards in the User's own name may be used.
- If the User uses a credit card under another person's name or a forged credit card, and the Company suffers damage as a result, the User shall be liable to compensate the Company for the damage.
- If the User selects payment at the facility, the User shall pay according to the method and conditions specified by the Accomodation Facilities.
Article 4 (Timing of Payment and Cancellation Fees)
- For reservations made more than 27 days prior to the checkout date, the validity of the card will be confirmed (authorization hold) on that date. Debit cards and certain credit cards may be charged or withdrawn on that date.
- For reservations made within 27 days of the checkout date, the validity of the card will be confirmed at the time of reservation.
- If the card cannot be verified, the reservation will be automatically canceled.
- The actual settlement (capture) will take place on the checkout date. In the event of settlement failure, the User must promptly settle the amount owed by the method specified by the Accomodation Facilities or the Company.
- In the event that a cancellation fee arises according to the cancellation policy of the Accomodation Facilities, if online payment is selected, the registered credit card will be charged; if on-site payment is selected, the User shall pay according to the instructions of the Accomodation Facilities.
Article 5 (User's Responsibility)
- The User guarantees that all information entered at the time of reservation is true, accurate, complete, and without omissions.
- If the User is a minor, the User must obtain consent from a legal guardian or custodian before using the Service.
- The Company shall not be liable for any damage caused by false, inaccurate, or incomplete information entered by the User.
Article 6 (Communication)
All communications from the Company to the User shall be made via the email address registered by the User. The Company shall not be liable if the User registers an incorrect email address or fails to receive communications for any reason.
Article 7 (Suspension or Interruption of Service)
The Company may suspend or interrupt all or part of the Service without prior notice to the User, and the Company shall not be liable for any damages caused thereby, in any of the following cases:
- When maintenance, inspection, or modification of the system of the Service is necessary
- When it is determined that the provision of the Service is difficult due to force majeure such as natural disasters, accidents, power outages, or communication failures
- When it is determined that provision is difficult due to unauthorized access, excessive concentration of access, system failure, or other similar reasons
- When the Company otherwise deems it necessary
Article 8 (Prohibited Acts)
The User shall not engage in any of the following acts or any acts that the Company deems to fall under the following:
- Acts that violate laws, regulations, or public order and morals, or acts related to crimes
- Acts that infringe the rights of other Users, third parties, or the Company (including intellectual property rights, portrait rights, privacy rights, honor, etc.)
- Acts of fraud, threats, slander, or harassment against the Company, other Users, or third parties
- Acts that place an excessive burden on or interfere with the system or network of the Service
- Acts of reverse engineering or analyzing the software or systems provided by the Company
- Transmitting the following information via the Service:
- False or unverified information
- Information containing violent or cruel expressions
- Obscene expressions, discriminatory expressions, or information encouraging suicide or self-harm
- Information encouraging improper drug use, anti-social information, or other offensive content
- Expressions that damage the honor or credibility of the Company, other Users, or third parties
- Information containing computer viruses or harmful programs
- Acts that may interfere with the operation of the Service
- Unauthorized access to or attempts to access the Company's systems or networks
- Impersonation of third parties or unauthorized use of other Users' IDs or passwords
- Acts that cause disadvantage, damage, or discomfort to other Users or third parties
- Advertising, solicitation, or commercial activities on the Service without the Company's permission (including inducing Users to other websites or services)
- Providing benefits directly or indirectly to anti-social forces
- Acts that promote, facilitate, or attempt any of the above acts
- Other acts that the Company deems inappropriate
Article 9 (Disclaimer of Warranty and Limitation of Liability)
- The Company makes no warranty, either express or implied, that the Service will fit the User's specific purposes, have the expected functionality, accuracy, usefulness, or continuity, or be free of defects.
- The Company does not guarantee that the services provided at the Accomodation Facilities will correspond exactly to the contents displayed in the Service, and shall not be liable for any discrepancies.
- Any disputes between Users and Accomodation Facilities shall be resolved by the Users at their own responsibility, and the Company shall not be involved or bear any responsibility whatsoever.
Article 10 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
