Dynamic Japan Travel Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions under which Dynamic Japan Travel (hereinafter referred to as the “Company”) provides its website and related services (hereinafter collectively referred to as the “Service”). All users of the Service (hereinafter referred to as “Users”) are deemed to have agreed to these Terms by using the Service.

Article 1 (Scope)

  1. These Terms shall apply to all matters between the Company and the Users concerning the use of the Service.
  2. Any additional guidelines, rules, or policies (hereinafter collectively referred to as “Individual Provisions”) that the Company posts or provides on the Service shall constitute a part of these Terms. In the event of any conflict between these Terms and such Individual Provisions, the Individual Provisions shall prevail.

Article 2 (Overview of the Service)

  1. The Service provides information about accommodation facilities located in Japan (hereinafter referred to as “Facilities”) and supports online reservations by Users.
  2. Reservations made through the Service constitute a direct transaction between the User and the Facility. The Company is not a party to any reservation transaction and shall not be liable for any disputes or damages arising between the Facility and the User.
  3. The Company does not operate as a travel agency under Japanese law. The Company does not act as an agent, intermediary, or broker for transactions between Users and Facilities.

Article 3 (Restriction on Use by Minors)

  1. Individuals under the age of 18 (“Minors”) are not permitted to use the Service.
  2. Even if a Minor uses the Service by providing false information or by any other means, the Company shall not be liable for any disputes or damages arising from such use.

Article 4 (User Registration)

  1. Users may be required to register for an account (free or paid, hereinafter “Registration”) in accordance with the procedures specified by the Company in order to use the Service. During the Registration process, Users must provide true and accurate information.
  2. If any information provided by a User is found to be false or inaccurate, the Company may restrict the User’s access to the Service or delete the User’s registration.

Article 5 (Account Management)

  1. Users shall manage their account information (login ID, password, etc.) at their own responsibility.
  2. The Company shall not be liable for any damages incurred by Users due to inadequate management of account information or unauthorized use by a third party.
  3. Users may not allow third parties to use, transfer, or lend their account.

Article 6 (Reservation)

  1. Users may apply for accommodation reservations through the Service. A reservation is considered valid when the Facility accepts the User’s reservation request. The Company is not a party to such transactions.
  2. Cancellations, changes, payment procedures, and all other matters related to reservations shall be handled directly between the User and the Facility, in accordance with the Facility’s rules and conditions.

Article 7 (Payment and Settlement)

  1. Accommodation fees and related costs (including taxes and service charges, hereinafter referred to as “Fees”) are independently set and managed by each Facility. Users shall pay the Fees according to the terms presented by the Facility.
  2. The Service may utilize external payment services such as Stripe (hereinafter referred to as the “Payment Service”). Users shall comply with the terms and policies of the Payment Service.
  3. The Company makes no guarantees regarding the processing of payments, including any fees or the success of transactions through the Payment Service. In the event a payment fails, the reservation may be canceled at the discretion of the Facility or the Company. The Company shall bear no liability for any consequences of such cancellations.
  4. The Company does not receive any Fees from the User. If any dispute or problem arises concerning payments, the Company shall not be liable.

Article 8 (Cancellation and Refund Policy)

  1. Cancellation and refund policies vary depending on the specific reservation plan. Some plans may allow cancellation within a certain period, while others may not permit any cancellation at all.
  2. For plans that do not allow cancellation, or in cases where the cancellation period has passed, no refunds will be provided under any circumstances.
  3. All procedures for cancellation, determination of refund amounts, and actual refund processing shall be conducted solely between the User and the Facility. The Company shall not be involved in or liable for such matters.

Article 9 (Support)

  1. Users shall directly communicate with the relevant Facility regarding any inquiries, changes, or cancellations related to reservations and accommodations.
  2. As the transaction is a direct arrangement between the Facility and the User, the Company does not provide inquiry support or other services. Users are responsible for resolving any issues directly with the Facility.

Article 10 (Facility Information and Content)

  1. The Facility information (including prices, amenities, services, photos, maps, etc.) published on the Service is managed and updated by each Facility. The Company does not guarantee the accuracy, timeliness, or usefulness of any such information.
  2. The Company shall not be liable for any errors or omissions in the Facility information, including cases where information is outdated or incorrectly posted.
  3. Users are advised to verify details with the Facility directly before making a reservation.

Article 11 (Prohibited Conduct)

Users shall not engage in any of the following activities when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activity
  3. Acts that infringe on the rights or interests of the Company, other Users, Facilities, or any third party
  4. Acts that interfere with the operation of the Service or damage the reputation of the Company
  5. Providing false or misleading information
  6. Any other acts deemed inappropriate by the Company

Article 12 (Changes, Suspension, and Termination of the Service)

  1. The Company may, without prior notice to Users, change or temporarily suspend the content of the Service.
  2. The Company may terminate the Service for unavoidable reasons. In such cases, the Company will provide prior notice to Users through reasonable means.
  3. The Company shall not be liable for any damages incurred by Users or third parties as a result of measures taken under this Article.

Article 13 (Disclaimer)

  1. The Company makes no warranty as to the accuracy, timeliness, or usefulness of Facility information, Fees, or other content posted on the Service. The Company shall not be liable for any damages incurred by Users or third parties as a result of such information.
  2. The Company shall not be involved in or liable for any disputes arising between a User and a Facility with respect to their direct contractual relationship (including reservations). In the event of a dispute, it shall be resolved by the User and the Facility.
  3. The Company shall not be liable for any direct, indirect, special, incidental, or consequential damages arising out of or in connection with the use of the Service.
  4. The Company is not a travel agency under the Japanese Travel Agency Act, and does not act as an agent, intermediary, or broker for transactions between Users and Facilities.

Article 14 (Intellectual Property Rights)

  1. All trademarks, logos, images, text, programs, and other intellectual property associated with the Service are the property of the Company or third parties who have valid rights to such content.
  2. Users shall not infringe upon these rights without obtaining prior permission from the Company or other applicable rights holders.

Article 15 (Changes to the Terms)

  1. The Company may change these Terms when it deems necessary. The revised Terms shall take effect once posted on the Service.
  2. By continuing to use the Service after the revised Terms become effective, Users are deemed to have agreed to the revised Terms.

Article 16 (Damages)

In the event a User violates these Terms and causes damages to the Company or any third party, the User shall be liable for such damages at the User’s own responsibility and expense.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms and all matters arising out of or relating to their validity, interpretation, and performance shall be governed by the laws of Japan.
  2. In the event of any dispute between the Company and a User arising in relation to these Terms or the Service, the court having jurisdiction over the location of the Company’s headquarters shall have exclusive jurisdiction.

Article 18 (Severability)

If any provision of these Terms is found to be invalid or unenforceable under applicable laws or regulations, the remaining provisions shall continue to be in full force and effect.
